I am writing regarding our phone call minutes ago and a September 21 press release by the Office of the Mayor. On behalf of my editor, Jeremy Parker, this is RVA Magazine’s Freedom Of Information Act request for the specific URLs (Uniform Resource Locations) referred to as “P8rn Sites” which were accessed by the city hall computer in Councilman William Pantele’s office. Since the Internet connection in City Hall is paid for by the taxpayer and “p8rnography” is arguably a subjective term unto itself, as members of the press, we consider collecting this specific information as pertinent and important to our jobs as it was to yours to let the public know of the general infraction(s).
As a secondary request, we would appreciate the telephone numbers of sex contractor services employed after hours from City Hall computers. Thank you.

The representation that President Pantele’s computers were accessible to others was made by “an employee in his office” and reported by Style Weekly’s Amy Biegelsen. In this e-mail, are you officially asserting that you agree that President Bill Pantele’s computer was accessible to others? Has anyone been prosecuted for the misuses of President Pantele’s specific computer?
In order to qualify as attorney work-product — which you are apparently alleging President Pantele’s computer’s web histories constitute — a document must be “prepared in anticipation of litigation.” Fed.R.Civ.Pro. 26(b)(3). If the city gathered the web histories as a part of a (to quote you) “continuing investigation of inappropriate usage,” on what date did these investigations begin in anticipation of litigation? How much of the web history catalogues comprising the “pattern of ‘p8rn site’” usage [here with one term spelled with an eight so as to transcend filtering] were able to accessed by city administrative computers before investigation “in anticipation of litigation” began?
Secondly . . .
On October 3, Bill Wasson of the Times-Dispatch wrote, “Black said the use of Pantele’s computer will be treated the same as the other cases of alleged computer misuse he is dealing with.” Harry E. Black’s word heeded, I request an additional press release be sent with the names’ of all other city employees whose computers may have been misused even by others to visit “p8rn sites.” After all, having for the first time conceded the poor security of Mr. Pantele’s work computer, would not you agree that leaving your office’s press disclosure “as is” might seem to some to constitute a very personal (as opposed to policy) bias against the President of City Council by your office?
Upon cessation of all investigation and/or potential litigation of any individuals by the city for this matter, I await the release of the materials I requested, including the phone records I mentioned earlier.
